Lummis Proposes Act to Shield AI Developers from Liability

Senator Cynthia Lummis introduced the Responsible Innovation and Safe Expertise (RISE) Act to protect artificial intelligence developers from civil liability. The bill, if passed, would require developers to disclose AI model specifications and for licensed professionals using these tools to perform due diligence and validate outputs. Lummis argues that this is needed because current legal frameworks expose developers to unnecessary risk even when they use AI responsibly. The RISE Act aims to provide clarity by requiring the disclosure of how AI was trained, tested, strengths, limitations, and prompts/constraints guiding its behavior. If a licensed professional uses an AI tool with clear understanding of its capabilities and encounters issues, the developer will be shielded from lawsuits, provided they met their obligations and acted responsibly.
