In the ongoing SEC v. Ripple case, the Securities and Exchange Commission (SEC) has filed opposition to nonparty Justin Keener’s second request for “decisive evidence.” The SEC argues that the court lacks jurisdiction over such a request because summary judgment is pending before the Second Circuit Court of Appeals, while also stating that Mr. Keener did not attempt to intervene in the lawsuit and was denied by the court earlier. Additionally, the SEC believes the request is unnecessary as it wouldn’t materially impact the case. This comes after the SEC dropped its lawsuit against Ripple in March but has delayed a complete dismissal pending further proceedings. The SEC’s deadline for reporting to the Second Circuit Court of Appeals is June 16th and this delay creates uncertainty surrounding the future of the XRP lawsuit.
