Two U.S. Senators, Sheldon Whitehouse and John Fetterman, have introduced the Clean Cloud Act of 2025 to regulate carbon emissions from data centers and cryptocurrency mining facilities. The proposed legislation aims to penalize companies using non-renewable energy sources by 2035 with fines based on inflation adjustments. This bill seeks to amend the existing Clean Air Act, requiring data centers exceeding 100 kilowatts in power capacity to comply with regional emission limits determined by the Department of Energy’s National Transmission Needs Study. Emissions caps will vary by region and be set by the end of 2025 before decreasing annually until reaching zero by 2035. Companies exceeding these emission limits face fines that cannot be passed on to consumers. The proceeds from the fines are intended to assist local governments in mitigating rising residential electricity costs while supporting clean energy initiatives.
