FTX Creditors Sue Kroll Over Data Breach, Demand Compensation

In a lawsuit filed against Kroll Restructuring Administration, FTX creditors are seeking compensation for the 2023 data breach that exposed personal information. The suit alleges negligence in response to the breach and demands systemic security improvements. 1.9 billion dollars is set to be disbursed for reimbursement claims this September. The case argues that Kroll’s breach allowed unauthorized access to employee mobile devices, exposing sensitive data such as full names, email addresses, home addresses, and FTX account balances. This ultimately led to phishing attacks targeting users, resulting in financial losses. Further, the lawsuit cites Kroll’s inadequate communication regarding the breach, which increased creditors’ vulnerability to scams. It highlights systemic issues in Kroll’s claim-processing procedures, including inconsistent KYC verification processes that blocked some users from submitting tax forms. This class action seeks multi-layered reform of Kroll’s systems through enhanced communication channels, alternative document upload methods not restricted by KYC and an independent security audit. If approved, eligible plaintiffs could be granted financial compensation for their losses.
